Palm Beach Country Estates Park

At the request of residents, South Indian River Water Control District staff prepared a Minor and Insubstantial Plan Amendment to the 13th Plan of Improvements to allow the District to provide maintenance of the Margaret Berman Memorial Park in Palm Beach Country Estates, which was approved by the Board of Supervisors in February 2011. The Board also established a yearly maintenance budget for the park.

 

In early 2014, Palm Beach Country Estates residents requested that the District seek the authority to construct the other planned improvements that had been approved by Palm Beach County. After determining that the District did have the ability to construct the improvements, the Board of Supervisors approved the construction of one large and two small covered pavilions, a racquetball court and a half basketball court. The construction of the three pavilions, and racquetball and basketball courts were completed the summer of 2015. The Palm Beach Country Estates Landowners Association, Inc., has also raised money for the playground equipment, benches and proposed fitness equipment along the walking trail. The Park is open from sunrise to sunset. The Park is available for use on a first-come, first-served basis, under the rules posted on this page. For special events utilizing vendors, please call the District at 561-747-0550 for a Park and Pavilion Usage Form. The Park cannot be reserved, but for special events, landowners must contact the District Office and complete a Park Use Form and must provide proof of Commercial General Liability insurance with limits not less than $1,000,000 per occurrence, combined single limit of liability for both property damage and bodily injury including death. A Certificate of Insurance listing the South Indian River Water Control District as an additional insured is required from each vendor and must be supplied to the District Office no later than five (5) days before the event date.

 

Margaret Berman Park pavilion in Palm Beach Country EstatesSponsors of the event must agree to follow the rules posted at the Park and understand that the Park is a carry-in/carry-out facility and that all litter and debris must be removed the same day, as well as agree to leave the Park in at least as good a condition as it was prior to the event. Sponsors must acknowledge that others are permitted to have access to the Park during the hours the event is being held.

 

The Sponsors must agree that they are liable to the South Indian River Water Control District for any damage that occurs during the event and understand that the District will not be liable for any claims for injury or damages resulting from or arising out of the use of the Park facilities during the event. They must agree to indemnify the District and hold it harmless against any and all such claims, damages, losses, and expenses, including reasonable attorney’s fees, as a result of the event. This provision is intended by the parties to be broadly interpreted so as to accomplish the goal of relieving the District from any cost or liability associated with the event.
