Landowner-Initiated Petitions

Petitions are used by landowners requesting capital improvements such as road paving or for requesting a "no-pave" restriction on a roadway. Landowners interested in road or other capital improvements or no paving requests must contact the District office and will be referred to the District Engineer for project review prior to issuing the District's authorized petition form.

 

As of March 16, 2023 the Board of Supervisors has established a Petition Review Fee of $400 for roadway segments 0.5 mile or less and $800 for over 0.5 miles. The fee applies to both road paving and "no pave" petitions. Petitions must be submitted to the District office, along with the review fee, by April 30th of each year.

 

If more than 50% of the landowners on a roadway or roadway segment request a road paving improvement and it is approved by the board to go to referendum, at least 90% of the affected landowners must be in favor for the project to proceed. Landowners would either be assessed on a per parcel bass through District financing, or the estimated costs for the project may be paid in full by landowners prior to the project being added to a Plan of Improvement. Currently District financing of projects is typically from 10 to 15 years depending on market conditions. For Open-Graded Emulsified Mix assessments, costs currently are estimated between $1,100 and $1,800 per parcel per year and for Asphalt, the estimated costs are between $1,800 and $2,500 per parcel per year, depending on construction costs and financing.

Current Petitions

The following Enhanced Stabilization petitions from Palm Beach Country Estates have been received for 2024.

  • 69th Trail N between 150th Place N and 154th Court N
  • 77th Trail N between 155th Place N and 159th Court N
  • 85th Way N between 155th Place N and 159th Court N
  • 86th Way N between 155th Place N and 159th Court N
  • 87th Trail N between 155th Place N and 159th Court N
  • 88th Trail N between 155th Place N and 159th Court N
  • 141st Lane N between 69th Drive N and 67th Avenue N
  • 154th Court N between 69th Drive N and 69th Trail N

141st Lane N between 69th Drive N and 67th Avenue N did not meet criteria however and will need to extend to 64th Drive N. The Board voted at their May 16, 2024 meeting to refund the petition fee.

 

At their June 20, 2024 meeting, the Board voted to proceed to referendum. After further clarifications by the Board at subsequent meetings, the final referendum estimate information was presented to the Board at their November 6, 2024, meeting ( rescheduled October meeting).

 

The District Engineer provided the estimated per lot annual assessment for financing at 10-15 year terms at between: $3,500 - $5,650 per lot for six of the roads and $6,500 - $8,900 per lot for one of the roads with only 2 lots. The Engineer requested and received Board authorization to proceed with preparing, printing and mailing of Referenda to affected landowners.

 

After a final review of updated Referendum Notice language at the December 6, 2024, meeting, the Board approved mailing the ballots. Ballots have been sent out to seven Palm Beach Country Estates Roads that petitioned for asphalt paving The District sent out referendum ballots for seven roadways in Palm Beach Country Estates on Friday, December 13, 2024. Affected Landowners on the petitioned roadways must return their ballots to the District Office by January 10, 2025. If anyone needs a replacement ballot, please contact Jennifer Hammond at the District office and bring a valid form of identification in order to be issued a replacement ballot.

 

The following No Enhanced Stabilization (No Pave ) petitions from Palm Beach Country Estates have been received for 2024.

  • 84th Ave N between 150th Court N and 154th Court N
  • 154th Court N between 81st Terrace N and 87th Trail N - Recommend it be extended west to 89th Avenue N

As 154th Court N does does not meet requirements, the Board voted at their May 16, 2024, meeting to refund the petition fee.

 

At their June 20, 2024 meeting, the Board approved this petition, and as per the Policies and Procedures Manual, the petition will remain on file for a period of 5 years.
